Part 1: Rezoning Applications, Subdivision Assumptions, and Servicing Policy Review - 08/20/2025

The Planning and Development Committee met on August 20, 2025, at Council Chambers in Shire Hall, with a hybrid format allowing both in person and virtual participation. The meeting was chaired by Councillor Phil St.-Jean (Picton) and was held as a public meeting under the Planning Act to consider planning applications, subdivision assumptions, policy matters, and related development items.

The Committee held statutory public meetings to hear rezoning applications as required under the Planning Act. These meetings allow Council to receive information, ask questions, and hear from applicants and members of the public.

Rezoning application for 3131 Victoria Road


The first statutory public meeting concerned a rezoning application by Brad Bamford Holdings Ltd. for lands located at 3131 Victoria Road in Ward 4 Ameliasburgh. Shawn Legere, President and Principal Planner with RFA Planning Consultant Inc., presented the application on behalf of the applicant. The proposal sought permission to convert an existing barn and the second storey of an existing garage into an event venue.


Committee members asked questions of the agent, followed by comments from members of the public. Rebecca Benson, owner and operator of Hopeful Acres Equine Services, raised concerns about traffic, noise, safety, and potential impacts on her business and property. Catherine Catania spoke in opposition, citing concerns about farmland loss, wildlife, environmental impacts, traffic, lighting, and noise. Gerry Inglis asked questions related to licensing, washroom facilities, food service, water supply, sewage, traffic routes, and noise.


The agent responded to questions and comments raised. No further discussion followed from Committee members. Council passed a motion to receive the oral submissions for information, and the statutory public meeting for this item concluded at 7:00 p.m.


Rezoning application for 247 Kingsley Crossroad


The second statutory public meeting addressed a rezoning application by Davin Corporation for lands at 247 Kingsley Crossroad in Bloomfield-Hallowell. Holly Newitt, Planner with Fotenn, presented the application, which proposed permitting a temporary contractor’s yard with a parking area.


No questions were raised by Committee members, and no members of the public spoke to the application. Council received the oral submissions for information, and the statutory public meeting concluded at 7:09 p.m. The Committee then formally adjourned the statutory public meetings portion of the agenda.


Following the statutory public meetings, the Committee considered subdivision assumption reports. Subdivision assumption is the process by which the municipality formally takes responsibility for subdivision infrastructure such as roads and services.


Pine Ridge Subdivision

Council considered a staff report related to the Pine Ridge Subdivision. No public comments were received. Council directed staff to issue a Certificate of Assumption, approved amendments to traffic and speed by laws to set a 50 kilometer per hour speed limit on Pineridge Drive, and authorized the placement of stop signs at specified intersections. A by law authorizing the assumption of all applicable subdivision works was approved.

Frank Street Subdivision

Council then considered the Frank Street Subdivision. Again, no public comments were received. Council directed staff to issue a Certificate of Assumption, approved changes to speed limits and traffic signage including an all way stop at Curtis and Buchanan Streets, and authorized the by law to assume the subdivision works.


Proposed amendments to the Servicing Allocation Policy


The Committee next addressed proposed amendments to the Servicing Allocation Policy EV800, which guides how water and wastewater capacity is allocated to development. Dorothy Bothwell spoke during the public comment portion and provided a presentation related to the proposed policy amendments.


Council received the public comments and the policy revision overview dated August 20, 2025. Council then directed staff to review best practices from other municipalities, obtain an external legal review, circulate the draft to the Water and Wastewater Rates Community Committee for input, and report back to a future Committee of the Whole meeting with a draft amended policy to be considered alongside the Development Charges Study.
